KeNHA has provided information necessary for five land owners of Mwamba Village Quarry in Turbo, Uasin Gishu County to seek compensation for their pieces of land acquired for the expansion of the Eldoret – Webuye – Malaba Highway. This follows a complaint lodged on behalf of the land owners by Mr. Eliud Kabagi under the Access to Information Act, 2016.
According to the complaint, KeNHA had failed to furnish them with a list of beneficiaries of the Mwamba Village Quarry compensation. The complainants alleged that they were among land owners whose pieces of land were acquired for the expansion of the highway between 2010 and 2012 pursuant to Gazette Notice Numbers 5078 and 5079 of 14th May 2010 and 7960 and 7961 of 8th July 2011. They, however needed the list of beneficiaries to ascertain ownership in order to enforce the right of compensation.
The Commission by a way of inquiry took up the issue with KeNHA and in a letter dated 20th February, the authority provided the requested documents to the office for further transmission to the complainants. The documents included a list of all beneficiaries indicating the amount compensated to each beneficiary, land plots numbers, Gazette Notices, copies of relevant correspondence and the survey map of Mwamba quarry.
Access to Information Law helps citizens to enjoy and protects other rights and freedom and gives the Commission the oversight and enforcement mandate.
