When his wife went to the delivery theatre at the Pumwani Hospital, Mr. Daniel Karue did not expect that the excitement would soon turn into physical, mental and psychological anguish for the next two years.
According to Mr. Karue, his wife, Ms. Consolata Mumbi, delivered on 21st January 2018 through caesarian section at the Pumwani Hospital. However, he was called into the theatre and was presented with a stillborn baby whose body was very cold and the belly button had already dried up, hence inconsistent with a fresh delivery. Having suspected that the baby his wife had delivered might have been exchanged for the stillborn baby, Mr. Karue reported the matter to California Patrol Base but he was informed that the matter was under the jurisdiction of the Directorate of Criminal Investigation(DCI).
Mr. and Mrs. Karue went to the DCI on 19th February 2019 where their Deoxyribonucleic Acid (DNA) samples were taken with a promise that the results would be out in three weeks. However, one and half years later, the DNA results had not been released, forcing the family to seek the help of Kituo Cha Sheria which wrote to the Independent Policing Oversight Authority but no help was forthcoming.
The inordinate delay in releasing the DNA results prompted Mr. Karue to lodge a complaint with the Commission on 21st June 2019. The Commission by way of inquiry took up the matter with the Government Chemist leading to the release of the DNA results which confirmed that Mr. and Mrs. Karue were not the parents of the stillborn baby and consequently, they have proceeded to court to seek justice.
