A former employee of Kerio Valley Development Authority(KVDA), Mr. Barnabas Kiplimo, was finally supplied with copies of documents by the agency following the intervention of the Commission.
According to Mr. Kiplimo, he made a request for information to the Authority in line with Section 8 of the Access to Information Act, 2016. However, the Authority did not respond to his information request within the required timeline prompting him to make an application for review with the Commission. The Commission took up the matter with the Acting Managing Director of KVDA requesting to know why the request had not been acted on. The Ag. MD responded by supplying some documents and noted that seven other documents which Mr. Kiplimo requested were confidential and could not be shared under Section 6 of the Access to Information.
The action of the Authority prompted the Commission to summon the Ag. Managing Director, Mr. Sammy Naporos, to appear before it on 7th November 2019 for questioning in a bid to have the issue resolved. The Commission after listening to both parties made a ruling that the Authority should supply Mr. Kiplimo with the documents within 21days as outlined in the Access to Information Act.
Mr. Kilimo expressed his gratitude to the Commission.
“I am delighted to report back that despite the initial hostility, I was ultimately provided with the copies of the sought documents…I would like to appreciate the Commission’s resoluteness, diligence, persistence and unwavering support on my case and cause. Without the effort of the Commission this progress would not have been realised,” he wrote in an appreciation letter.
