An Assistant Welfare Officer with the Nairobi City County was finally reinstated following the intervention of the Commission.
According to Mr. James Nyamwega, he was interdicted in September 2016 on allegations of impersonation, insubordination and authorising construction of illegal structures in Karen Ward. He however, responded to the show cause letter which led to his reinstatement to the position of Assistant Welfare Officer with additional responsibilities and was deployed to Lang’ata Sub County.
However, on 13th February 2018 he was summarily dismissed for the very reasons he had previously been cleared of in September 2016, prompting him to lodge an appeal against his dismissal with the Public Service Commission(PSC) on 15th March 2018.
The PSC noted that the appeal had been submitted prematurely before the Commission since he had not exhausted the appeal process of the County Government Public Service Board. The Commission also noted that the records held in Mr. Nyamwega’s personal file indicated that the discipline case had earlier been resolved by the Chief Officer- Public Service Management–on the advice of the Chief Officer- Sub County Administration which led to Mr. Nyamwega’s interdiction being lifted and his redeployment to Lang’ata Sub County.
The PSC in a letter to the secretary of the County Public Service Board requested that the appeal be handled taking cognisance of the anomaly. However, one year later the County Public Service Board had not heard and determined his appeal. This situation prompted him to lodge a complaint with the Commission.
The Commission by way of inquiry took up the issue with the Secretary, Nairobi City County Public Service Board which led to his reinstatement under his previous terms after the consideration of his appeal.
